Special Investigation Service decided that RA State Guard Regiment battalion commander Karen Hayrapetyan didn’t hinder the professional activities of “A1+” journalist Marine Khachatryan. The criminal case, initiated with regard to RA Criminal Code Article 164, Part 1, was rejected for lack of corpus delicti. Connected with the famous incident near NA gates, Senior Investigator of especially important cases, Justice Lieutenant Colonel V.G. Avetisyan has decided: “No to carry out criminal prosecution over RA State Guard Regiment battalion commander Karen Hayrapetyan with regard to RA Criminal Code Article 118, Article 164 Part 1, Article 185 Part 1 and Article 186 Part 1 and terminate No. 61207214 criminal proceedings- for lack of corpus delicti.” On September 9, while covering “Hakaharvats” (Counterblow) street art group action, the chief of the NA security Karen Hayrapetyan hit A1+’s journalist Marine Khachatryan on the arm, causing her to drop her recording device – iPad – to the ground. Karen Hayrapetyan tried to hit the second time but he missed. But while making the decision on terminating the case, the investigator concluded, that: “There is lack of corpus delicti in the act of K. Hayrapetyan intended by RA Criminal Code Article 118, Article 185 and 186 Part 1, which intend criminal responsibility for beating Marine Khachatryan as well as intentionally or negligently damaging her property.” During 7 days the decision may be appealed to a higher court. We remind that Special Investigation Service once refused to institute a criminal case for lack of corpus delicti. But on October 7, RA General Prosecutor abolished the decision by the SIS on the denial of initiating a criminal case with regard to the incident with A1+ journalist and with regard to the case of hindrance to the legal professional activities of a journalist, a criminal case initiated in accordance with RA Criminal Code Article 164, Part 1 was taken into the RA Special Investigation Service proceedings.
