The preliminary investigation ended: SIS

The preliminary investigation of the criminal case instituted under Article 309, Part 2 of the Criminal Code of the Republic of Armenia with regard to the excess of official powers with the use of violence has ended in the proceeding of the Special Investigation Service of the Republic of Armenia. The preliminary investigation revealed that on February 28, 2014 Gnel, Arsen and Aramayis Hayrapetyans were called to the Police Vardenis Department for the purpose of verifying information and getting explanations from them with regard to the bodily injuries caused to a citizen Arayik M., which occurred on February 26, 2014. On the same day from 4 till 5PM, a Head of Department for Juvenile Matters of Vardenis department of the Police of the Republic of Armenia Artyom Tatosyan in his workroom applied violence to Arsen Hayrapetyan form the purpose of getting information about the case on bodily injuries caused to Arayik M. For the same purpose, the Deputy Head for Operational Matters of Vardenis Department of the Police of the Republic Armenia Vard Grigoryan also applied violence to Arsen Hayrapetyan. Afterwards Arsen Hayrapetyan was taken to another room of Vardenis department of the Police where Tatosyan struck the latter with his “Makarov” gun for the purpose of getting the same information from him by causing him bodily injuries. On February 28, 2014 in the evening Artyom Tatosyan, Vard Grigoryan and the Head of the Criminal Investigation of the same department Karen Harutyunyan also desired to get information regarding the same case from Gnel Hayrapetyan who was also exposed to violence by causing slight harm to his health, but with no injuries. On the same day the Deputy Head for Operational Matters of Vardenis Department V.Grigoryan threatened Arsen Hayrapetyan that if he did not provide information regarding the bodily injuries caused to Arayik M., he would not allow him to go home. With a view to getting information V.Grigoryan without any grounds stipulated by the law, illegally detained Gnel, Arsen and Aramayis Hayrapetyans in custody, thereby harming the latters’ rights and legal interests. It should be reminded that charges were brought against the Head of Department for Juvenile Matters of Vardenis Department of Gegharkunik Regional Administration of the Police of the Republic of Armenia Artyom Tatosyan, Deputy Head for Operational Matters of the same Department Vard Grigoryan and the Head of the Criminal Investigation Department Karen Harutyunyan under Article 309, Part 2 of the Criminal Code of the Republic of Armenia. It should be mentioned that in the prejudicial proceeding an arrest has been determined in regard to Artyom Tatosyan as a measure of restraint, and Vard Grigoryan and Karen Harutyunyan were given a written undertaking not leave the country. The investigator accomplishing the preliminary investigation has handed over the criminal case along with the indictment to the public prosecutor in charge of exercising the judicial management for it to be approved and referred to the court.
